Shipping & Handling:

Fast, Reliable Shipping:

  • Most orders ship the same day we receive them. During our busiest times orders ship within 48 hours. The average order takes approximately 5 days to arrive at your doorstep. Some orders arrive sooner, depending where you are located. Your customer service representative can provide approximate shipping times to you.

  • S&H fees are based on the total weight of your order and calculated on UPS Shipping rates.

  • Express orders received by 2:00 p.m. EST will ship the same day. Orders received after 2:00 will ship the next business day.

  • We ship to anywhere within the continental US States. At this time we can not accept orders from other countries.

Returns/Exchange Policy:

Definitions:
"Seller" shall mean Advanced Computer Solutions of Endicott, New York. "Buyer" shall mean the person, or entity which executes an order with The Seller via our online ordering system or verbally via Phone.

Refund Policy on Computer Hardware:
Computer Hardware products may be returned for a refund at anytime for any reason for 30 days from the date of invoice, but is subject to a 15% restocking fee. Credit for non-defective returns will be given at Seller's currently published price on date of receipt of goods from Buyer minus a 15% restocking fee. Defective products qualifying for Warranty Service will be repaired or replaced through the Manufacturer's Warranty Policy.

Refund Policy on Computer Software:
Unopened software products can be returned to Seller for a Refund at Seller's currently published price on date of receipt of goods from Buyer, but is subject to a 15% restocking fee. Under no circumstances can opened software products be returned for credit and/or exchange. All Defective Software products should be directed to the Manufacturer of the Software.

Procedure for Obtaining a Refund/Exchange:
Prior to returning any products to Seller, Buyer must obtain a Return Merchandise Authorization ("RMA") Number from Seller. A RMA number may be obtained by calling Seller's Service department at (607) 786-9974 or by e-mail at service@advancedcomputer.com. Upon receipt of the RMA number, the Buyer should proceed by shipping the product in original Manufacturer's packaging including all cables and manuals back to Seller at the expense of the customer. If any cables and/or manuals are missing from product packaging, Buyer will be subject to a 15% or $20 restocking fee whichever is higher. Shipping Charges are non-refundable under any circumstances.

If for some reason your credit card is fraudulently charged, under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50 of fraudulent charges. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.

Terms and Conditions of Sale:

Purchase Of Goods:
Seller hereby sells to Buyer and Buyer hereby buys from Seller, the Goods described in the electronic shopping cart. The Goods, together with all replacement parts, repairs, additions, substitutions and accessories are hereafter collectively referred to as the "Goods".

Acceptance of Terms & Conditions:
The Buyer agrees to be bound by the terms and conditions set forth in this document and indicates the acceptance of these terms and conditions by submitting an order to The Seller, be it verbally by phone, or electronically via The Seller's Online Ordering system.

Term and Payments:
The term of this Agreement shall commence on the day of the month in which the Goods are delivered to Buyer. Buyer agrees to pay all amounts due to Seller within 30 days from the Invoice date located on the face of this document. Whenever any payment is not made by Buyer when due, Buyer agrees to pay Seller interest on all monies due to Seller, including overdue interest from and after the date of default at the annual rate of twelve percent (21.99%) calculated and payable monthly until paid in full but in no event more than the maximum rate permitted by law.

Limited Warranty:
By accepting this agreement, Buyer agrees to the Warranty Policies as set forth by The Seller. Seller's Warranty Policy as well as procedures for obtaining Warranty service can be found below. The Seller's warranty policy is subject to change at anytime without notice, Buyer agrees to be bound by any changes in the Seller's warranty program as part of the acceptance of these terms & conditions.

Disclaimer of Warranties and Claims:
The Buyer acknowledges that Seller is not the manufacturer of the Goods. Buyer acknowledges that Seller makes no representations or warranties to anyone, express, implied or statutory (including warranties of merchantability, condition, design, operation, marketability, quality or fitness for any use or purpose) as to any aspect of the Goods, or as to whether the Goods are subject to any liens, claims or other encumbrances except as mentioned in above section. Seller shall not be liable for any injury to Buyer or to any third person or property, including direct, indirect, consequential, incidental and special damages caused by the use, ownership, manufacture, installation, or operation of the Goods, or any delay or failure by the manufacturer or supplier to repair or maintain the Goods or provide parts, or supplies for the Goods, and the Buyer acknowledges that no such delay or failure shall in any way affect the Buyer's obligations under this Agreement. If the Goods do not operate as represented by the manufacturer or supplier, or is unsatisfactory for any reason whatsoever the Buyer shall make any such claim solely against the manufacturer or supplier and Buyer hereby waives any such claim against Seller and agrees to continue to make all payments to Seller stipulated by this Agreement notwithstanding any such claims. No representation or warranty by the manufacturer or supplier is binding on Seller nor shall breach of such warranty relieve Buyer of its obligations to Seller. Seller hereby assigns to the Buyer, to the extent assignable and without recourse to Seller, all warranties from the Manufacturer to Seller provided that if the Goods are returned to or repossessed by Seller, all such warranties shall be deemed to have been reassigned to Seller.

Risk of Loss:
Buyer shall bear all risks of loss or damage to Goods from any cause from date of shipment to Buyer. Buyer shall immediately notify Seller of any damage to or destruction of the Goods. In the event of loss or damage, Seller will replace damaged Goods with substantially identical Goods in good condition and working order. Buyer agrees to assist the Seller in all necessary procedures in the process of insurance collections.

Indemnity:
Buyer shall indemnify and hold Seller harmless from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including legal fees (on a solicitor and own client basis) arising out of, connected with, or resulting from the Goods or this Agreement. Such indemnity shall survive the termination or expiration of the Agreement.

Consent to Jurisdiction, Governing Law and Waiver:
Buyer consents to the personal jurisdiction of the courts of the State of New York with respect to any action arising out of this Agreement or the Goods. Service of process by registered mail or by facsimile shall be deemed the equivalent of personal service in any such action. This Agreement shall be governed by and construed according to the laws of the State of New York. To the extent permitted by law, Buyer hereby waives any and all rights and remedies granted it by the provisions of any law, statute or regulation which would, in any manner, affect Seller's rights and remedies hereunder.

General:
This Agreement shall inure to the benefit of and is binding upon the heirs, personal representatives, successors and permitted assigns of the parties hereto. Time is of the essence of this Agreement. This Agreement contains the entire arrangement between Seller and Buyer, and no modification of this Agreement shall be effective unless in writing and executed by Seller. All covenants and obligations of Buyer to be performed pursuant to this Agreement, including all payments to be made by Buyer hereunder, shall survive the expiration or earlier termination of this Agreement. If more than one Buyer is named in this Agreement, the liability of each shall be joint and several. In the event any provision of this Agreement shall be unenforceable, then such provision shall be deemed deleted, however all other provisions hereof shall remain in full force and effect.

Warranty Information:

Warranty on Computer Hardware:
The Seller warrants all computer hardware purchases for 30 days from the date of invoicing. Some products may carry a manufacturer's warranty longer than the warranty provided by the Seller. In this case, all claims should be directed to the specific product manufacturer. Certain Manufacturers' Warranty Policies require The Buyer to obtain all Warranty Service directly from them. If the Manufacturers' Policy of product requiring warranty service requires said actions, The Seller provides no warranty of such items. The Seller agrees to provide any documentation regarding product purchased from The Seller to assist The Buyer in obtaining Warranty service from said Manufacturers.

Warranty on Computer Software:
The Seller provides no warranties on software products. Unopened software products may be returned for a refund, however, under no circumstances will any refunds or exchanges be accepted on opened software products. If a software product is found to be defective, all claims should be directed to the software manufacturer.

Limitations & Exclusions:
The Warranty provided by The Seller is limited in nature. Product failures due to but not limited to processor overclocking, misuse or improper handling of computer components, cracked display screens, static discharge, or acts of God are not covered under this warranty. Seller reserves the right to terminate the remainder of the warranty and/or refuse warranty service for any case for which the Seller, at its sole discretion, determines product failure was caused by misuse, abuse, or improper handling, or any of the above mentioned caused.

Obtaining Standard Warranty Service:
The Seller requires that Buyer obtain a Return Merchandise Authorization Number ("RMA") before shipping any products found to be defective back to Seller. A RMA number may be obtained by calling Seller's Service department at (607)786-9974 or by e-mail at service@advancedcomputer.com. Upon receipt of the RMA number, the Buyer should proceed by shipping the defective product including all cables and manuals back to Seller at the expense of the customer. The shipping package should be marked with the RMA number assigned to you and attn: RMA Department. Upon receipt of the package Seller will ship a replacement part via UPS Ground back to the Buyer at Seller's expense. All products found to be in working condition on arrival to Seller will be subject to a 15% restocking fee. If service faster than UPS Ground is needed, Buyer will bear all shipping costs regarding the replacement of the product.
